FindMyNanny is the ‘agency’, Candidate means a person introduced by the Agency, ‘Client’ refers to the person to whom the candidate is referred. Candidate: Nanny either part time/full time. These terms, conditions are between ‘Agency’ and the ‘client’.

These terms and conditions represent a legally binding contract between the Agency and the Client. The verbal/written instruction by the Client to the Agency to submit suitable Candidates for contact or interview or arrangement of interviews will constitute acceptance by the Client of these terms and conditions.

Client’s responsibilities

1. The client agrees to pay the fees as illustrated, payable by the client to FindMyNanny Agency for being introduced to and hiring a candidate.
2. FindMyNanny Agency is an introductory agency only and does not employ any candidates. The client is responsible for the payment of wages.
3. Contracts of employment between the client and the candidate are the client’s responsibility. However, FindMyNanny Agency has a contract template that can be used at no extra cost, but we do not accept any responsibility or liability for this contract.
4. We can provide our advisors suggestions about insurance matters with accepting no responsibility. Client is fully responsible for this subject matter.

Our liability

FindMyNanny Agency will not be legally responsible under any circumstances for any loss, damage, expense, delay, costs or compensations (whether direct, indirect or consequential) which may be suffered or incurred by the client, as a result of an introduction by the agency.

FindMyNanny Agency will not be liable to the client for any loss of any kind suffered by the client as a result of the candidate failing to present for work at any time.

Confidentiality

Clients are not allowed to reveal or disclose any personal confidential, commercial, or confidential technical information relating to the business, finances or affairs of the other to any persons, firm or organization. The restriction extends after the completion of business for any reason without time limit except information which comes from the public domain.

All introductions are confidential, and clients MUST NOT pass any information about the candidate introduced by FindMyNanny Agency to other parties. Any employment offers must go through the Agency.

Refunds and replacements Policy

If an offer of employment is accepted and the client withdraws the offer after candidate acceptance, the client will be liable for 50% of the placement fee.

If a client decides to have our agency candidate in a probation period, and unsatisfied, suitable replacement will be offered if available. If a replacement cannot be found within 21 days, then refunds are available on a pro rata basis

This agreement will be void if

• Fees are not paid within 14 days of the Nanny start date
• FindMyNanny Agency was not informed in writing within 7 days of the Nanny leaving
• Nanny leaves due to change in working conditions from agreement, for example change in rate pay, unreasonable demands, change of location etc.
• Mistreatment of the Nanny
• If the client terminates the employment offer when there has been no breach of contract by the nanny
